Affiliate Program Terms & Conditions

1. Agreement to Terms

By applying to or participating in the BDM Hub Affiliate Program ("Program"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("Affiliate") and BDM Hub ("Company," "we," "us," or "our").

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued participation in the Program after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility Requirements

To be eligible for the Program, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal authority to enter into this agreement
• Maintain an active website, blog, or social media presence
• Have an audience genuinely interested in business tools and software
• Comply with all applicable laws and regulations
• Provide accurate and complete information during application
• Not be a competitor of BDM Hub or represent competing interests

3. Application Process

Application to the Program does not guarantee acceptance. We review all applications and reserve the right to accept or reject any application at our sole discretion. Factors we consider include:

• Quality and relevance of your content
• Audience demographics and engagement
• Marketing strategy and approach
• Compliance with our brand guidelines
• Previous affiliate marketing experience

We will notify you of our decision within 2-3 business days. If accepted, you will receive access to your affiliate dashboard and marketing materials.

4. Commission Structure

4.1 Standard Commission Rates

You will earn the following commissions on successful referrals:

• Individual Plugin ($10/month): 30% = $3/month recurring
• All Access Bundle ($49/month): 30% = $14.70/month recurring
• Annual Plan ($490): 30% = $147 one-time
• Lifetime Access ($1,200): 30% = $360 one-time

4.2 Performance Bonuses

Additional commission rates based on monthly performance:

• Bronze Tier (5+ referrals): +1% bonus (31% total)
• Silver Tier (15+ referrals): +2% bonus (32% total)
• Gold Tier (30+ referrals): +3% bonus (33% total)
• Platinum Tier (50+ referrals): +5% bonus (35% total)

4.3 Commission Qualification

Commissions are earned only on valid sales that meet our qualification criteria. A sale is considered valid when the customer has completed payment and the transaction has been processed successfully.

5. Payment Terms

5.1 Payment Schedule

Commissions are calculated monthly and paid on the 15th of each month for sales made in the previous calendar month. If the 15th falls on a weekend or holiday, payment will be made on the next business day.

5.2 Minimum Payout

The minimum payout threshold is $50.00. If your commission balance is below this amount, it will carry over to the next month until the threshold is met.

5.3 Payment Methods

We offer the following payment methods:

• PayPal (preferred method)
• Bank transfer (ACH) for US affiliates
• Check for US affiliates

5.4 Tax Responsibilities

You are responsible for all taxes related to commission payments. US affiliates earning over $600 annually will receive a 1099-MISC form. International affiliates are responsible for their own tax compliance.

6. Affiliate Obligations

6.1 Marketing Standards

You agree to:

• Promote BDM Hub in a professional and ethical manner
• Provide accurate information about our products and services
• Use only approved marketing materials or get approval for custom content
• Comply with FTC guidelines and disclose your affiliate relationship
• Maintain the quality and reputation of your promotional platforms

6.2 Disclosure Requirements

You must clearly and conspicuously disclose your affiliate relationship in all promotional content. Acceptable disclosures include:

• "This post contains affiliate links. I may earn a commission if you make a purchase."
• "As a BDM Hub affiliate, I earn from qualifying purchases."
• "#affiliate #sponsored" in social media posts

6.3 Compliance

You must comply with all applicable laws, regulations, and industry standards, including but not limited to FTC guidelines, CAN-SPAM Act, and GDPR where applicable.

7. Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination:

• Spam email marketing or unsolicited communications
• Paid search advertising on BDM Hub brand terms
• False or misleading advertising claims
• Self-referrals or fraudulent transactions
• Cookie stuffing or other fraudulent tracking methods
• Promoting on adult or inappropriate content sites
• Creating unauthorized coupon or deal sites
• Trademark or copyright infringement
• Negative SEO or competitive sabotage
• Misrepresenting yourself as BDM Hub employee or official representative

8. Intellectual Property

8.1 License Grant

We grant you a limited, non-exclusive, non-transferable license to use our trademarks, logos, and marketing materials solely for promoting BDM Hub through the Program.

8.2 Usage Guidelines

You may not modify our trademarks or logos without written permission. All marketing materials must comply with our brand guidelines, which will be provided upon acceptance into the Program.

8.3 Ownership

All intellectual property rights in BDM Hub products, services, and marketing materials remain our exclusive property. This agreement does not transfer any ownership rights to you.

9. Termination

9.1 Termination by Either Party

Either party may terminate this agreement at any time with or without cause by providing 30 days written notice.

9.2 Immediate Termination

We may terminate this agreement immediately without notice if you:

• Violate any term of this agreement
• Engage in fraudulent or illegal activities
• Damage our reputation or brand
• Fail to maintain program requirements

9.3 Effect of Termination

Upon termination, you must immediately cease all promotional activities and remove all BDM Hub marketing materials. You will receive payment for any earned commissions up to the termination date, subject to our standard payment terms.

10. Limitation of Liability

To the maximum extent permitted by law, BDM Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

Our total liability under this agreement shall not exceed the total commissions paid to you in the twelve months preceding the claim.

11. General Provisions

11.1 Independent Contractor

You are an independent contractor and not an employee, agent, or representative of BDM Hub. This agreement does not create any partnership, joint venture, or agency relationship.

11.2 Governing Law

This agreement is governed by the laws of [Your State/Country], without regard to conflict of law principles.

11.3 Severability

If any provision of this agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.

11.4 Entire Agreement

This agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings relating to the subject matter.
